General Terms and Conditions of Sale and Use

ARTICLE 1 – Application and Concept

Pixel Rush is an interactive entertainment concept owned by the company SASU Intervalle. These general terms and conditions of sale apply to any facility-access contract entered into between (1) any company within the SASU Intervalle group and (2) users of the facility, hereinafter referred to as "USERS", whether they have made the reservation themselves or are part of the team of the person who made the reservation, hereinafter referred to as the "PURCHASER". These terms also apply regardless of the booking method, whether the reservation is made via the Pixel Rush website, hereinafter referred to as the "WEBSITE", or through the staff of SASU Intervalle. The entertainment facility made available to players is referred to as the "FACILITY" and the access contract as the "CONTRACT". The game session for which the PURCHASER reserves and pays on the WEBSITE is referred to as the "GAME SESSION". SASU Intervalle reserves the right to modify, in whole or in part, these general terms and conditions of sale as well as the content of its WEBSITE (https://pixelrush.fr), at its sole discretion, at any time and without prior notice. The general terms and conditions of sale of SASU Intervalle are available on the WEBSITE and may be freely consulted upon simple request to the reception staff of SASU Intervalle.

ARTICLE 2: BOOKING

Access to the Pixel Rush entertainment facility is granted exclusively after a reservation made either on the WEBSITE at https://pixelrush.fr or through the staff of SASU Intervalle. The reservation is made for a specific date and time slot, and is only valid for that time slot. Reservations are subject to availability, which is updated in real time on the website. A reservation is only confirmed once the customer has received a confirmation email from SASU Intervalle. You are responsible for the accurate entry of your contact details in the online booking form. By submitting the form, you guarantee to SASU Intervalle that the details provided are true and accurate. SASU Intervalle cannot be held responsible for any input errors or incorrect date and time choices on your part. Reservations may be rescheduled up to 7 days before the date of the GAME SESSION, subject to availability, upon written request to contact@pixelrush.fr. Within 7 days of the session, no changes, cancellations or rescheduling are possible. Under no circumstances is a GAME SESSION refundable.

ARTICLE 3 – USE OF THE FACILITY

In accordance with the Pixel Rush concept, SASU Intervalle grants USERS the right to occupy the Pixel Rush entertainment facility for a maximum duration of 60 (sixty) minutes. The sole purpose of occupying the facility is to participate in the events organised by SASU Intervalle, which must be carried out in teams of 2 to 5 players depending on availability at a specific time slot. USERS accept that the duration of their presence in the facility is strictly limited to 60 minutes, during which they may freely enjoy the various activities on offer. This allocated time does not depend on the success or failure of a mission, but simply corresponds to the time allotted to experience Pixel Rush. Furthermore, USERS accept that their session ends automatically at the end of these 60 minutes, without entitlement to any price adjustment or compensation. Admission to the Pixel Rush entertainment facility is only possible upon presentation of the booking confirmation email (sent shortly after the payment process to the PURCHASER) and a valid identity document of the PURCHASER. Access to activities is reserved for USERS aged 6 years and over. At least one adult must be present for each SESSION. If there is any doubt about a USER's age, SASU Intervalle reserves the right to request proof of identity.

USERS are required to keep the facility and all its equipment (non-exhaustive list: decorations, furniture, electronic devices, etc.) in good condition and to use them in accordance with their authorised purpose. Accordingly, the USER acknowledges that any intentional damage or damage caused by unauthorised handling of the premises or equipment will be subject to additional charges.

Furthermore, the USER must ensure that no damage is caused to other USERS, the premises or SASU Intervalle's equipment. Throughout their time at the Pixel Rush facility, the USER undertakes to behave respectfully, to comply with the rules in force and to cooperate with SASU Intervalle staff. Accordingly, SASU Intervalle does not tolerate any form of violence, whether verbal or physical, or harassment or intimidation of its employees and/or other USERS. The company therefore reserves the right to refuse entry to or remove any person whose behaviour is deemed inappropriate.

SASU Intervalle also reserves the right to refuse entry to any person under the influence of alcohol or illegal substances, for the safety of themselves and those around them. No compensation or refund will be granted in the event of refused entry on these grounds.

ARTICLE 4 – PRICING

Prices displayed by Pixel Rush are in euros, inclusive of all taxes, taking into account the VAT rate applicable on the date of the order; any change in the rate may be passed on to the price of services. Pixel Rush's prices are listed on the website. Any additional service will give rise to supplementary billing. Pixel Rush reserves the right to modify its prices at any time. Each PURCHASER will pay the amount corresponding to the price in force at the time of their reservation.

In the event that USERS arrive late for a reserved SESSION, the USER may decide whether or not to begin their session. In all cases, the facility must be vacated at the time stated in the original reservation. Pixel Rush reserves the right to refuse entry to USERS who are 15 minutes or more late. Session times will be systematically reminded in the confirmation emails sent by Pixel Rush.

If fewer USERS show up to participate in the SESSION than originally planned at the time of reservation, the PURCHASER and/or USERS are not entitled to a refund of the price difference. If more USERS show up to participate in the SESSION than originally planned at the time of reservation, the price difference must be settled before participating, within the limit of the maximum number of USERS authorised in the facility.

Pixel Rush reserves the right to refuse any reservation from a PURCHASER who has not paid all amounts previously billed to them.

ARTICLE 5 – CORPORATE CLIENTS

This article applies to companies that have made reservations outside the website. Prices charged by SASU Intervalle are stated in the quote and vary depending on the service agreed contractually with the PURCHASER. Payment may be made by the PURCHASER by cheque or bank transfer. A 50% deposit must be paid at the time of ordering to confirm the reservation. The balance is due no later than the day of the event. In the event of total non-payment 7 days before the service, SASU Intervalle reserves the right to cancel the order. The number of missions may be revised downward (by a maximum of one mission) up to 7 days before the date of the service.

Once the order has been placed by the PURCHASER (evidenced by the signing of a quote bearing the notation "agreed"), the following cancellation conditions apply:

• Cancellation 15 days or more before the date of the service:
- If full payment or the deposit has already been made, no refund will be issued.
- If no payment has yet been made, a penalty of 50% of the total price including tax will be charged.
- SASU Intervalle may offer a new date to reschedule the session.

• Cancellation between 15 and 7 days before the date of the service:
- If full payment or the deposit has already been made, no refund will be issued.
- If no payment has yet been made, a penalty of 50% of the total price including tax will be charged.
- No rescheduling will be offered.

• Cancellation less than 7 days before the date of the service:
- If full payment or the deposit has already been made, no refund will be issued.
- If no payment has yet been made, a penalty of 100% of the total price including tax will be charged.
- No rescheduling will be offered.

ARTICLE 6 – RIGHT OF WITHDRAWAL

In accordance with article L121-21-8 of the French Consumer Code, the right of withdrawal cannot be exercised for contracts relating to services in the fields of accommodation (other than residential), transport of goods, car rental, catering, or leisure activities which must be provided on a specific date or during a specific period.

Consequently, no reservation may be cancelled or refunded, except in the event of a cancellation initiated exclusively by SASU Intervalle.

In the latter case, the full amount of the original reservation will be refunded.

ARTICLE 7 – PERSONAL DATA

The PURCHASER is responsible for the accuracy of the information entered in the online booking form on the WEBSITE.

The PURCHASER agrees to receive information and commercial offers from SASU Intervalle at their email address or on their mobile phone.

The PURCHASER and/or USER who enters their telephone number on the SASU Intervalle WEBSITE already agrees to be contacted by SASU Intervalle by phone or SMS.

The PURCHASER who provides the contact details of other players / USERS (first and last names, phone numbers, email addresses) authorises SASU Intervalle to send information and commercial offers to them.

SASU Intervalle undertakes not to transmit the personal data of its USERS to any company outside the SASU Intervalle group, except upon request from an authority empowered by law and within the framework of applicable legal provisions.

ARTICLE 8 – SAFETY

The USER undertakes to comply with all safety measures communicated to them, whether contractual, displayed on site, or given verbally by SASU Intervalle staff.

Smoking inside the premises is strictly and formally prohibited.

Each USER undertakes to read and comply with the fire safety and protection instructions, as well as the emergency exits. It is strictly forbidden to obstruct emergency exits, which must remain clear at all times.

The USER may use the emergency exits if and only if the situation requires evacuation of the premises. Any misuse and/or improper opening of these exits by one or more USER(S) will result in the billing of costs incurred by such misuse.

The USER is aware that it is strictly forbidden to bring into the premises and the ROOM objects classified as:
(1) physical hazards (explosive, flammable, oxidising, pressurised or liquefied gas, corrosive),
(2) health hazards (toxic, skin corrosive, irritant/sensitising, carcinogenic/teratogenic),
(3) hazardous to the aquatic environment.

Similarly, the use of force and/or violence is strictly prohibited.

Any damage to the facility resulting from abnormal use of the gaming area may give rise to additional charges.

ARTICLE 9 – PHOTOS AND CAMERAS

Photos of each team of USERS may be taken before or after the game session. These photos may be used by SASU Intervalle to populate its website or digital ecosystem (non-exhaustive examples: Facebook, Twitter, Instagram, etc.). SASU Intervalle cannot be held responsible for any use made of the photos by the USERS and/or the PURCHASER. Each ROOM is equipped with a video surveillance and audio monitoring system allowing SASU Intervalle staff to follow the game session and guide USERS as needed.

ARTICLE 10 – INTELLECTUAL PROPERTY

All elements, texts, videos and images on the website www.pixelrush.fr are the exclusive property of Pixel Rush. Any reproduction is strictly prohibited.

ARTICLE 11 – MISUSE OF SAFETY DEVICES

Any misuse of safety devices, in particular the deliberate and unjustified activation of manual fire alarms on our premises, is strictly prohibited. Such misuse may result in billing of the costs incurred (fire brigade intervention, interruption of activity, etc.) up to the amount of costs actually borne by Pixel Rush, without prejudice to any further legal proceedings. By confirming the reservation, the customer acknowledges and accepts this obligation.

ARTICLE 12 – JURISDICTION

These general terms and conditions and any contract incorporating these terms and conditions are governed by French law, and all disputes are subject to the exclusive jurisdiction of the French courts.

ARTICLE 13 – VIDEO RECORDING AND RIGHT TO IMAGE

As part of the promotion of its interactive entertainment concept, SASU Intervalle (Pixel Rush) may film or photograph USERS during their GAME SESSION, exclusively for the purpose of creating communication content (publication on social media, website, advertising materials, etc.).
Such recordings will only be made and published with the explicit prior consent of the USERS concerned.
This consent may be collected:
• either by signing a specific authorisation form before the start of the GAME SESSION,
• or by electronic validation at the time of online booking.
USERS retain the right at all times:
• to refuse to be filmed or published,
• or to withdraw their consent at any time after publication, in accordance with articles 6 and 7 of the General Data Protection Regulation (GDPR).
In the event of withdrawal of consent, SASU Intervalle undertakes to delete or anonymise the images concerned as quickly as possible across all its communication channels.
No commercial exploitation or transfer of these images to third parties will be carried out without the express agreement of the USERS.
Recordings made in the context of security and the smooth running of activities (video surveillance) will never be used for communication or public broadcast purposes, except with the separate and explicit consent of the USERS.
